				<content:encoded><![CDATA[<p>Here is another example of an employer allegedly mis-classifying employees and not paying them overtime hours correctly. Employees should always be aware of their &#8216;status&#8217; with their employer, and makes sure they are being classified correctly, and paid correctly!</p>
<p>Employees for Russell Stover Candies Inc. filed a federal wage-and-hour lawsuit against the company, saying they were intentionally mislabeled as sales representatives and none of them &#8220;has ever been paid overtime.&#8221;</p>
<p>Russell Stover Candies Inc., based in Missouri, employs about 5,000 people, including more than 170 sales representatives, the complaint said. The &#8220;overwhelming majority&#8221; of its candy is delivered to retailers like Walmart and grocery stores.</p>
<p>Nine workers said Russell Stover &#8220;misnamed them as &#8216;sales representatives,&#8217;&#8221; making them exempt from overtime, when none of them worked primarily in sales, as required by the Fair Labor Standards Act of 1938. Most of the company&#8217;s sales are performed or originate from employees other than the plaintiffs, the court filing said.</p>

				<content:encoded><![CDATA[<p>A directory assistance and enhanced information company with a headquarters in Hanover Township PA, has violated federal minimum wage standards since 2009, a federal judge ruled last week.</p>
<p>New York-based <a href="http://www.kgbusa.com/">KGB USA Inc.</a> was ordered to pay $1.3 million to nearly 15,000 current and former employees, the U.S. Department of Labor announced this morning in a news release.</p>
<p>The company&#8217;s business process outsourcing headquarters is at 3864 Courtney St. in Hanover Township, according to the company&#8217;s website. That address is cited in  giving the court in the Eastern District of Pennsylvania jurisdiction in the case, according to court papers.</p>
<p>U.S. District Judge James Knoll Gardner said in a Feb. 7 consent decree that the company misclassified home workers, who were hired to respond to text messages from customers, as independent contractors, the Labor Department reports. The workers were paid a piece rate instead of $7.25 an hour, an investigation of the department&#8217;s Wage and Hour Division revealed&#8230;</p>

<p>&#8220;Employers have an obligation to pay workers the wages they&#8217;ve earned,&#8221; said Christine Baker, director of the California Department of Industrial Relations. &#8220;Forcing employees to wait for payment or depriving them of promised benefits are illegal acts and cause unacceptable hardship.&#8221;</p>
